Copyright & Fair Use Policy for Reserves

In compliance with the Agreement on the Guidelines for Classroom Photocopying in Not-for-Profit Educational Institutions with Respect to Books and Periodicals (H. R. 94-1476) and Section 107: Fair Use (Title 17, U.S. Code) of the Copyright Act of 1976 the following policy will be applied to copyrighted photocopied materials to be place on reserve.

Materials which may be placed on reserve without obtaining copyright permission:

  • Exams
  • Lecture notes
  • Virtually all Government publications (there are exceptions)

Portions of copyrighted materials that may be photocopied or scanned and placed on electronic reserve:

  • A chapter from a book.
  • An article from a periodical or a newspaper
  • A short story, essay or short poem
  • A chart, graph, diagram, drawing, cartoon or picture from a book, periodical or newspaper

Copyrighted materials that may not be photocopied or scanned and placed on reserve:

  • Pages from works intended to be "consumable" in course of study or teaching. These include workbooks, exercises, standardized tests, test booklets and answer sheets.
  • An entire book, whether in-print or out-of-print (electronic reserves only)

Length of time photocopied/scanned materials may be on reserve:

Photocopies of copyrighted materials may be placed on reserve for one semester only without permission. If the instructor wishes to keep these materials on reserve for more than one consecutive semester, permission from the copyright holder must be requested. Once the request has been made the material can remain on reserve pursuant to the copyright holder's response. If permission is not granted than the material must be taken off reserve. (The library will make the request for permission if needed)

When copyright permission is needed:

  • When a journal article, book chapter or a portion of a work is on reserve for consecutive semesters.
  • When multiple articles from one issue of a journal are needed for reserve during the same semester.
  • When multiple chapters from a book are needed during one semester.

Additional Guidelines for UIS Electronic Course Reserve:

  1. Access to the documents in course reserve will be limited to faculty and students registered in each course.

  2. The following copyright warning will appear on each copyrighted documents:

    WARNING CONCERNING COPYRIGHT RESTRICTIONS

The copyright law of the United States (Title 17, United state Code) governs the making of photocopies or other reproduction of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproductions. One of these specified conditions is that the photocopy or reproduction is not to be used for any other purpose other than private study, scholarship, or research. If electronic transmission of reserve material is used for purposes in excess of what constitutes "fair use", that user may be liable for copyright restrictions or permission has been granted by the publisher.

  3. Material on electronic reserve will be accessed by course number, professor name and document title.

  4. At the end of each semester, all material on electronic reserve will be removed unless it does not fall under copyright restrictions or permission has been granted by the publisher. In the case of students with incompletes the instructor must notify the circulation staff to extend access to those needed course materials.
